Abstract

The transformation of the land system from analog to digital is a strategic step by the Indonesian government to realize modern, transparent, and accountable land governance. This study aims to analyze the media transfer mechanism and issuance of electronic land certificates at the National Land Agency (BPN) Office in Temanggung Regency and examine them from an Islamic legal perspective using the Maslahah al-mursalah theory. The research method used was juridical-empirical (field research) with a descriptive qualitative approach. Data were collected through in-depth interviews with agrarian officials at the Temanggung Regency BPN, village officials, and beneficiary communities, as well as observation, supported by documentation studies. Data analysis was conducted interactively through data reduction, data presentation, and conclusion drawing. The primary analytical framework used was the Maslahah al-mursalah theory in ushul fiqh. The results indicate that the digitalization mechanism in Temanggung Regency is implemented through two main channels: media transfer of analog files and direct issuance of new land titles, which in practice is massively supported by the Complete Systematic Land Registration (PTSL) program and the "Sentuh Tanahku" application. From the perspective of Islamic jurisprudence (ushul fiqh), this digital transformation qualifies as a permissible maslahah mursalah (wholesome benefit) because it is oriented towards the public good (al-maslahah al-’ammah) and is substantially correlated with efforts to preserve wealth (hifzh al-mal) and preserve lives (hifzh al-nafs) from land conflicts. This benefit is categorized as maslahah hajiyyah despite social resistance in the form of limited digital literacy in rural communities that require ongoing assistance and education. This obstacle does not invalidate the value of this system's maslahah, so the ruler's policy is considered legitimate and in line with the principles of maslahah al-mursalah.
